Does your company have employees in the State of Illinois? If so, on 1/1/11, Illinois law prohibits most employers from inquiring into an employee’s credit history or taking an adverse employment action because of their credit history or report. The company must establish that creditworthiness is a bona fide job qualification in order to inquire into an employee’s credit history. Are your company’s job descriptions up-to-date in the sense of establishing that a credit report is required for those positions that you have determined that creditworthiness is a bona fide job qualification?
